1. General provisions

These Payment and Cancellation Conditions govern the contractual relationship between SRL PAMPY, with registered office at Cahul, str. Viteazul Mihai, 2, ap.(of.) 61, acting as the Seller, and the Buyer, in accordance with Law no. 105 of 13.03.2003 on consumer protection and Law no. 284 of 22.07.2004 on electronic commerce.

2. Payment methods

2.1. Accepted methods

The Seller accepts the following payment methods:

• Online bank card payment (Visa, Mastercard, Apple Pay, Google Pay)
• Bank transfer
• Cash on delivery (cash or POS terminal)
• Payment through electronic payment services authorized in the Republic of Moldova

2.2. Payment confirmation

The order is considered confirmed after receipt of full payment or the agreed advance payment. For cash on delivery, the order is confirmed after validation by the operator.

2.3. Transaction security

All online transactions are processed through secure systems that comply with international security standards. Bank card data is not stored on the Seller’s servers.

2.4. Issuance of tax documents

According to the Fiscal Code of the Republic of Moldova, the Seller issues a fiscal receipt and/or tax invoice for each completed transaction.

3. Prices and fees

3.1. Price display

All prices displayed on the website include VAT according to the legislation in force in the Republic of Moldova.

3.2. Price changes

The Seller reserves the right to modify prices without prior notice. The price valid at the time of order confirmation applies.

3.3. Delivery cost

The delivery cost is specified separately and added to the order value, being communicated to the Buyer before completing the order.

4. Right of unilateral withdrawal from the contract (return)

4.1. Legal terms

According to art. 10 of Law no. 105/2003 on consumer protection, the Buyer has the right to unilaterally withdraw from the contract within 14 calendar days from the date of receiving the goods, without stating a reason and without penalties.

4.2. Return conditions

To exercise the right of return, the product must meet the following conditions:

• It must not have been used
• It must retain its original appearance, tags, and original packaging
• It must be accompanied by the fiscal document (receipt/invoice)
• It must not show signs of wear or damage

4.3. Exceptions from the right of return

According to the legislation in force, the following cannot be returned:

• Products made according to the consumer’s personal specifications
• Perishable products or those with a short shelf life
• Sealed products that have been unsealed and cannot be returned for hygiene or health protection reasons
• Sealed audio, video recordings, or software that have been unsealed
• Periodical publications
• Personal hygiene products

4.4. Return procedure

To return a product, the Buyer must:

1. Contact customer service at +40 753 120 270, pampymd@gmail.com within 14 days
2. Complete the return form (available on the website or sent by the Seller)
3. Send the product to: Cahul, str. Viteazul Mihai, 2, ap.(of.) 61
4. Return shipping costs are borne by the Buyer, except in cases of defective products or incorrect delivery

4.5. Refunds

The Seller will fully refund the amount paid, including the initial delivery cost (if applicable), within 14 days from receiving the return notice, but not before receiving the returned product or proof of shipment.

The refund is made using the same payment method used for the purchase, unless the Buyer expressly agrees to another method.

5. Order cancellation

5.1. Cancellation by the Buyer

The Buyer may cancel the order:

• Before the product is shipped – without additional costs
• After the product is shipped – the return procedure under section 4 applies

5.2. Cancellation by the Seller

The Seller may cancel the order in the following situations:

• The product is no longer in stock
• The contact information provided is incorrect or incomplete
• Fraud suspicion
• Force majeure

6. Defective or non-conforming products

6.1. Legal warranties

According to Law no. 105/2003, the Buyer benefits from:

• Conformity warranty for new products
• The right to request repair, replacement, price reduction, or contract termination in case of non-conformity

6.2. Complaint deadlines

The Buyer may claim product non-conformity within:

• 2 years for new products
• 1 year for second-hand products

6.3. Complaint procedure

For defective or non-conforming products:

2. Provide proof of purchase and a description of the issue
3. The product will be collected free of charge by the Seller for evaluation
4. The Seller will resolve the complaint within a maximum of 15 business days

6.4. Costs

All costs related to returning defective or non-conforming products are borne by the Seller.

7. Personal data protection

Personal data processing is carried out in accordance with Law no. 133 of 08.07.2011 on personal data protection and the Seller’s Privacy Policy.

8. Dispute resolution

8.1. Amicable resolution

The parties undertake to resolve amicably any dispute arising in connection with the execution of this contract.

8.2. Consumer protection authority

The Buyer may submit a complaint to the Agency for Consumer Protection and Market Surveillance:

8.3. Court of law

If no amicable settlement is reached, disputes shall be resolved by the competent courts of the Republic of Moldova.

9. Final provisions

9.1. Amendments

The Seller reserves the right to amend these Conditions, with prior notice to Buyers by publishing the new version on the website.

9.2. Entry into force

These Conditions enter into force on 04.03.26 and apply to all orders placed after this date.
