1. General provisions

1.1. These Warranty Terms & Conditions (hereinafter – the “Conditions”) set out the rules for granting and performing the warranty for products purchased from pampy.ro (hereinafter – the “Seller”).

1.2. The Conditions are prepared in accordance with:

• Law of the Republic of Moldova no. 105 of 13.03.2003 on consumer protection;
• Law of the Republic of Moldova no. 133 of 08.06.2012 on consumer rights for purchases made via the internet or other distance-selling conditions;
• Civil Code of the Republic of Moldova;
• Applicable legislation of the Republic of Moldova.

1.3. The warranty applies to products purchased from the Seller, except for cases expressly provided in these Conditions.

2. Warranty period

2.1. The warranty period is specified in the warranty certificate or in the product description on the website.

2.2. If no warranty period is expressly indicated, the following legal minimums apply:

• Consumer goods for daily use: minimum 12 months;
• Long-term use goods: minimum 24 months;
• Complex technical equipment: according to the manufacturer’s specifications, but not less than 12 months.

2.3. The warranty period starts from the moment the product is handed over to the Buyer, confirmed by signing the delivery note or the tax invoice.

2.4. For seasonal products (clothing, footwear), the warranty period starts from the beginning of the relevant season according to applicable regulations.

3. Warranty coverage conditions

3.1. The warranty covers manufacturing defects and malfunctions occurring during normal use of the product according to its intended purpose.

3.2. To benefit from the warranty, the Buyer must present:

• Proof of purchase (tax invoice/receipt);
• Warranty certificate (if applicable);
• The product in its original packaging (if possible);
• Identity document.

3.3. The warranty is valid throughout the territory of the Republic of Moldova.

4. Cases where the warranty does not apply

4.1. The warranty does not cover:

a) Malfunctions caused by:

• Improper or negligent use of the product;
• Failure to follow operating instructions;
• Unauthorized interventions or repairs by unauthorized persons;
• External factors (shocks, impacts, drops, flooding, fire, unstable electrical voltage);
• Normal wear and tear.

• b) Products with expired shelf life (food, cosmetics, medicines);
• c) Products showing visible mechanical damage caused by the Buyer;
• d) Warranty certificate filled in incorrectly or showing erasures/alterations;
• e) Serial numbers that do not match or have been altered;
• f) Defects communicated to the Buyer at the time of purchase (defective/discounted items with disclosed defects).

4.2. The warranty does not cover:

• Consumable accessories (batteries, bulbs, filters, etc.);
• Normal wear of components (battery capacity decrease, natural fading, etc.).

5. Rights under warranty

5.1. If a defect is discovered during the warranty period, the Buyer may choose to request:

• a) Free repair within a reasonable time (no more than 30 days);
• b) Replacement with a similar product within 14 days;
• c) A proportional price reduction;
• d) Full refund and contract cancellation.

5.2. If the product has been repaired twice for the same defect and the issue persists, the Buyer may request replacement or a refund.

5.3. If the product is repaired under warranty, the warranty period is extended by the time the product spent in service.

6. Warranty claim procedure

6.1. To benefit from warranty services, the Buyer must:

• b) Describe the reported defect;
• c) Provide the product together with the documents listed in section 3.2.

6.2. The Seller will examine the product within a maximum of 5 business days from receipt.

6.3. If necessary, the product will be sent to an authorized service center for diagnosis.

6.4. Diagnosis is performed within a maximum of 14 calendar days.

6.5. The Buyer will be informed about the diagnosis result and proposed solutions within 2 business days after completion.

6.6. Shipping to/from service is handled as follows:

• In Chișinău municipality: free of charge, organized by the Seller;
• In other localities: costs are initially borne by the Buyer and reimbursed if the defect is recognized as covered by warranty.

7. Product return outside warranty

7.1. According to Law no. 133/2012, the Buyer may return an online-ordered product within 14 days from receipt, without stating a reason.

7.2. For a return, the product must be:

• Unused;
• In original packaging;
• With tags intact;
• With all accessories and documents.

7.3. The paid amount will be refunded within a maximum of 14 days from receipt of the returned product.

8. Exclusions from the right of return

8.1. Under applicable legislation, the following cannot be returned:

• Opened personal hygiene products;
• Perishable food products;
• Sealed products that have been unsealed;
• Software, digital licenses;
• Made-to-order or personalized products;
• Newspapers, magazines, periodicals.

9. Dispute resolution

9.1. The parties will make every effort to resolve disputes amicably.

9.2. If no amicable solution is reached, the Buyer may file a complaint with:

• Agency for Consumer Protection and Market Surveillance (www.aplcc.md);
• Competent courts under the laws of the Republic of Moldova.

9.3. The Buyer may also use an online dispute resolution platform, if available.

11. Final provisions

11.1. The Seller reserves the right to amend these Conditions by publishing the new version on the website.

11.2. The applicable version is the one in force on the date the order is placed.

11.3. These Conditions are drafted in Romanian and are governed by the laws of the Republic of Moldova.
